High court drops
charges against Auda, AMC chiefs
Gujarat high Court has discharged
contempt of Court proceedings against
AMC Chief and chairman of Auda after they submitted an affidavit assuring
that they will follow all orders on fire safety. The division bench of
justice J M Panchal and H H Mehta discharged the petition observing that
they were not able to implement the Court order due to prevailing conditions.
Earlier, the high Court had
issued contempt of Court notices against the duo as they had failed to
implement orders on fire safety. The high Court had observed that though
the authorities had all the power they had not implemented the high court’s
order.
However, the advocates pleaded
that the three different division bench of high court gave varied rulings,
so it was difficult to implement them, they added. They also submitted
that the earlier division bench had ordered that fire safety installation
should be done in such a manner that common people should not be affected.
They had kept this in mind
while implementing the high Court orders. The flat owners of high-rises
had also approached the high Court for concession against cutting essential
services like light, water and drainage facilities, which complicated
the matter, they added.
