SC upholds HC order favouring AMC employees
The
Supreme Court on Tuesday upheld an earlier decision of a division bench
of the Gujarat high court wherein the Ahmedabad Municipal Corporation
was ordered to regularly pay the salary to the temporary staff in the
octroi department.
About 31 temporary staff
had earlier filed a writ application at the high court contending that
as they had worked for about 900 days in the last five years at the AMC,
they should be inducted into the organisation. But the single judge bench
of the court rejected the writ plea. The employees then filed a leave
petition at the high court and the division bench passed an order in favour
of the employees.
The AMC then moved to Supreme
Court challenging the high court order. Senior advocate Yatin Oza appearing
for the employees said the employees were entitled to be regularised as
per the corporation’s rule. He also said even the division bench
of the high court had ordered in favour of the employees. The SC then
upheld the decision of the division bench of the Gujarat high court in
favour of the employees.
